Contributor License Agreement

Thank you for your interest in contributing to Fathometer ("the Project"), which is maintained by THEKROLL LTD ("the Project Owner").

This Contributor License Agreement ("Agreement") sets out the terms under which You contribute to the Project. It protects You as a contributor as well as the Project Owner and the Project's users; it does not change Your rights to use Your own Contributions for any other purpose.

By signing this Agreement (see "How to sign" below), You accept and agree to the following terms for any past and future Contributions You submit to the Project.

1. Definitions

  • "You" / "Your" means the individual or legal entity that signs this Agreement. If You sign on behalf of an employer or other legal entity, You represent that You are authorized to do so and that the entity is bound by this Agreement.
  • "Contribution" means any original work of authorship, including any modifications or additions to existing work, that You intentionally submit to the Project (e.g. via pull request, patch, issue attachment, or other communication) for inclusion in the Project.

2. Copyright license

You grant to the Project Owner, and to recipients of software distributed by the Project Owner, a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable copyright license to reproduce, prepare derivative works of, publicly display, publicly perform, sublicense, and distribute Your Contributions and such derivative works.

3. Patent license

You grant to the Project Owner, and to recipients of software distributed by the Project Owner, a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable (except as stated in this section) patent license to make, have made, use, offer to sell, sell, import, and otherwise transfer Your Contribution, where such license applies only to those patent claims licensable by You that are necessarily infringed by Your Contribution alone or by combination of Your Contribution with the Project. If any entity institutes patent litigation against You or any other entity alleging that Your Contribution, or the Project to which You contributed, constitutes direct or contributory patent infringement, then any patent licenses granted to that entity under this Agreement for that Contribution or Project shall terminate as of the date such litigation is filed.

4. Relicensing

You acknowledge that the Project is currently distributed under the Apache License, Version 2.0. You agree that the Project Owner may license Your Contribution under the Apache License 2.0 and, at the Project Owner's discretion, under other license terms (including future versions of the Apache License or other open-source or commercial license terms), provided that the Contribution remains available to the public under at least one OSI-approved open-source license.

5. Your representations

You represent that:

  • Each of Your Contributions is Your original creation, or You otherwise have the right to submit it under this Agreement.
  • Your Contribution does not, to Your knowledge, violate any third party's copyrights, patents, trademarks, or other intellectual property rights.
  • If Your employer has rights to intellectual property You create, You have received permission to make the Contribution on behalf of that employer, or Your employer has waived such rights for Your Contributions to the Project.
  • You are not aware of any third-party licenses or other restrictions (including export restrictions) that apply to Your Contribution and that You have not disclosed to the Project Owner.

6. No obligation; no warranty

You are not expected to provide support for Your Contributions, except to the extent You desire to do so. Unless required by applicable law or agreed to in writing, You provide Your Contributions on an "AS IS" basis, without warranties or conditions of any kind, either express or implied.

7. Notification

You agree to notify the Project Owner of any facts or circumstances of which You become aware that would make these representations inaccurate in any respect.

How to sign

This Project uses CLA Assistant Lite. When You open a pull request, an automated check will ask You to sign. To sign, add the following comment on the pull request (exact text):

I have read the CLA Document and I hereby sign the CLA

Your GitHub username will be recorded as a signature. Signing once covers all of Your future contributions to this Project. If You contribute on behalf of an entity, state the entity's name in the same comment.
